TVJ loses bid to bar CVM from carrying World Champs footage

The Court of Appeal has denied Television Jamaica’s appeal against a Supreme Court ruling that gives CVM TV the right to carry footage of the World Championships now underway in Beijing, China.

TVJ took the matter to the Appeals Court today after Supreme Court judge David Batts refused to grant an injunction against CVM.

The judge held that the material was permissible based on the fair use exceptions in the Copyright Act.

According to Justice Batts, CVM did not carry the championships live and only portions of the footage were used for a discussion programme on a current event.

TVJ, which has exclusive broadcast rights for the Championships, appealed the ruling this afternoon.

Justice Patrick Brooks reviewed the appeal in chambers and refused to overturn the Supreme Court order.

Brooks says TVJ can renew its application when the Court of Appeal resumes on September 24.

TVJ's lawyer, Georgia Gibson-Henlin says a decision has not yet been made.

TVJ’s claim is based on CVM's continued use of exclusive licensed footage including entire races in their programme 'Return to the Nest'.
