Judicial Review Court to hear case of dismissed Morant Bay High principal

Former principal of Morant Bay High School, Dr Dalton Shaw, has been given the go ahead to take his fight to get back his job to the Judicial Review Court.

The Supreme Court has also extended the injunction barring the school's board of management from filling the position.

The hearing at the review court has been set for three days beginning on September 25.

Shaw, who is being represented by attorney-at-law Andre Earle is seeking to overturn a decision of the Appeals Tribunal of the Teachers’ Service Commission, which upheld his dismissal.

He was terminated in 2014 by the Morant Bay school board on allegations of neglect of duty, professional misconduct and improper conduct.

Shaw challenged the Board’s decision at the Commission arguing that the Personnel Committee erred in its conduct during the proceedings and that it breached natural justice.

However, his application was dismissed by the Commission and he subsequently  took the matter to the appeals tribunal which also ruled against him.
