Appeal Court quashes policeman's conviction;orders retrial
The Appeal Court has quashed the murder conviction of police corporal, Vince Edwards, and set aside his 15-year prison sentence.
The court also ordered that the case be sent back to the circuit court for a re-trial.
Edwards was found guilty in April 2011 for killing Tyrone Powell during an incident in Cooreville Gardens, St Andrew in 2009.
However, the Court of Appeal, in overturning the verdict, says an assessment of the legal arguments presented by Edwards' attorney, Valerie Neita-Robertson, shows that the trial judge made a number of errors in his direction to the jury.
Among them, the court says, is the treatment of the unsworn statement Edwards gave during his trial and the handling of the defence available to him as a police officer in the lawful execution of his duty.
