Setback for Rev Al Miller in court case

THE Reverend Merrick 'Al' Miller has lost his battle in the Judicial Review Court to bar Resident Magistrate Georgianna Fraser from trying his case of attempting to pervert the course of justice.

The charges were preferred in 2010 after then fugitive Christopher 'Dudus' Coke was found in the company of the pastor in a car along the Mandela Highway in St Catherine.

Miller had asked the RM to step down from the case on the grounds that she was the person who signed the warrant of arrest for Coke in 2010.

He also argued that Fraser had presided at the proceedings when Coke waived his right to an extradition hearing.

Fraser refused to step down from the case and Miller took the matter to the Judicial Review Court.

Senior Puisne Judge Gloria Smith heard the matter and in handing down her decision yesterday threw out Miller's motion saying the grounds on which he had filed the application were without merit.
