WESTERN BUREAU:The inmates who allegedly beat one of the suspects in the murder of Mario Deane are booked to appear in the Montego Bay Resident Magistrate's Court on January 8, 2015.
Colin Malcolm and Omar Mitchell, who are charged with assault occasioning bodily harm against Marvin Orr, were given the new court date when they appeared in court yesterday.
"The medical certificate is ready for service on defence counsel," Clerk of the Court Natalie Malcolm told presiding Magistrate Carolyn Tie, while adding that the prosecution would call on two witnesses when the matter is being tried.
The court was also told that, while Mitchell had taken up his bail, Malcolm was still in police custody for another matter which is before the Circuit Court.
The allegations against Malcolm and Mitchell are that on August 14, Orr was asleep in his cell at the Barnett Street Police Station when he was awakened by voices.
It is further alleged that one of the two defendants accused him of urinating in the passage and ordered him to clean it. Mitchell then bashed Orr's head against the wall, and both men reportedly stepped in his stomach.
The alleged attack against Orr happened just over a week after Deane, who was initially taken into police custody for possession of a ganja spliff, was savagely beaten in his cell at the Barnett Street Police Station. Deane subsequently died in hospital on Independence Day.
Orr and another inmate, Adrian Morgan, have been charged in connection with Deane's death. They will appear in court on January 16, 2015.
