Millwood wins Privy Council appeal
The Ezroy Millwood led National Transport Cooperative Society (NTCS) has won its appeal at the UK Privy Council against the government over an arbitration award.
The case is in relation to the government’s takeover of the public transport system in the Kingston Metropolitan Tansport Region five years before the 10-year contract with the NTCS had expired.
The Privy Council today ruled in favour of Millwood and has sent the case back to the Court of Appeal.
The Court of Appeal is to consider the consequences in light of the fact that the duration of the franchise agreement was only three years and not 10 as was previously argued.
Lord Anthony Gifford, the attorney for the NTCS said the Millwood led organization will be awarded in excess of a billion dollars plus interest.
The government is to pay Millwood’s legal cost.
