Businessman freed of gun charges arising from road rage incident

Businessman D'Oyen Duncan was freed of gun-related charges when he appeared in the Gun Court on Tuesday.

He was charged with assault at common law, using a firearm to commit a felony and unauthorised possession of a firearm arising from a road rage incident.

However, he was freed following a no-case submission by his attorney Able-Don Foote who was able to discredit the complainant's account of the incident.

During cross examination, the sole eyewitness failed to accurately support crucial points in the Crown's case. He admitted to not being certain of where the weapon was drawn from and that he was not truthful in saying he was able to clearly identify the accused.

The lawyer then submitted that the quality of the eyewitness was unreliable and unsafe.

It was alleged that on July 12, 2023, Duncan was driving a Toyota Rav4 Sports Utility Vehicle along Sydney Road onto St Lucia Avenue in New Kingston.

He almost collided with the complainant's motorcycle and there was a verbal clash.

It was reported that Duncan brandished a gun, pointed it at the complainant and then drove away.

The matter was reported to the police and following an investigation Duncan was arrested and charged.
