Bail reduced for businessman accused of defrauding car buyers

Businessman Nicholas Morgan, who is charged on allegations of collecting over $8 million from several persons and failing to deliver on motor vehicles, today had his $1.6 million bail cut in half in the St Catherine Parish Court as he seeks to make restitution.

Morgan, 35, is answering to six counts of fraudulent conversion, four counts of failing to deliver goods, one count of obtaining money by means of false pretence, and one count of misleading and deceptive conduct.

In making an application, his attorney Danae Reid argued that her client had no criminal intention and was willing to repay the complainants.

Reid told the court that Morgan's ability to pay back the complainants depends on his being granted bail in a manageable sum.

“Your honour, if he is bailed with one bail bond it is easier, and he is desirous of returning the funds collected,” Reid said.

Senior Parish Court Judge Desiree Alleyne then vacated the previous bail offer of $200,000 per complainant, of which there are seven, amounting to a total bail of $1.6 million, and imposed a bail of $700,000 with surety.

Morgan was ordered to report to the Duhaney Park police on Mondays and Thursdays and return to court on December 9.

The judge said the only reason she decided to adjust bail was to allow the accused to refund the complainants.

He was warned to ensure that he treated that as a priority.

Allegations are that Morgan, who operates a car company, collected varying sums of money from the complainants to supply them with motor cars.

He allegedly failed to honour his obligation, and the matter was reported to the police and an investigation was launched.

This resulted in Morgan being arrested.

He was subsequently charged.

He has made several court appearances in the matter.
